ARTICLE 1. SEDGWICK COUNTY ENFORCEMENT

2-101. Interlocal Service Agreement with Sedgwick County.

The Governing Body of the City of Kechi is hereby authorized to enter into an Interlocal Service Agreement for Animal Control Service and Enforcement as codified in chapter 5, inclusive, of the Sedgwick County Code, as amended; by and between the City of Kechi and Sedgwick County, Kansas.

2-102. Adoption.

Sedgwick County Code, Sections 5-1 et seq., as amended, is hereby approved and adopted by the Governing Body of the City of Kechi, Kansas as prepared and published by Sedgwick County, Kansas and the same are hereby incorporated by reference as if fully set out herein.

2-103. Code open to public.

Not less than three (3) copies of Chapter 5 of the Sedgwick County Code shall be filed with the City Clerk to be open for inspection and available to the public at all reasonable business hours.

2-104. Conflicts.

Any provisions of Chapter II of the Kechi City Code in conflict with Chapter 5 of the Sedgwick County Code are hereby superseded and replaced by the applicable Sedgwick County Animal Control Code Sections so long as the City of Kechi continues to be bound by the provisions of the Interlocal Service Agreement for Animal Control Service and Enforcement between the City of Kechi, Kansas and Sedgwick County, Kansas.

2-105. Enforcement jurisdiction.

The City of Kechi, Kansas hereby confers jurisdiction within its incorporated boundaries upon Sedgwick County in order to further effectuate the provisions of Chapter 5 of the Sedgwick County Code, as amended. The City defers all prosecutorial decisions to the County and any fines collected as a result of said prosecutorial efforts shall be retained by the County and the City shall make no claim or demand for any portion of any fines collected by the County as a result of enforcement activity within the corporate boundaries of the City. Sedgwick County Animal Control shall perform any and all animal control service or enforcement so long as the City of Kechi and Sedgwick County, Kansas continue to be bound by the said Interlocal Service Agreement for Animal Control Service and Enforcement.
